Terms and Conditions

1. Scope

These Terms and Conditions apply to all orders placed via the online shop ivape.ch, operated by MacherWeb GmbH, Kasernenstrasse 77A, 8004 Zurich (hereinafter "iVape"). By placing an order, the customer accepts these Terms and Conditions.

2. Age Restriction (18+)

Under the Swiss Tobacco Products Act (TabPG), e-cigarettes, e-liquids and related products may only be sold to persons aged 18 and over. By placing an order, the customer bindingly confirms that they have reached the age of 18. iVape collects the date of birth during the ordering process and reserves the right to verify the age upon delivery and, in cases of doubt, by means of suitable proof. Orders from minors will not be fulfilled; any payments already made will be refunded in such cases.

3. Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By submitting an order, the customer makes a binding offer. The contract is concluded upon the order confirmation by email or upon delivery of the goods. iVape may decline orders without stating reasons, in particular where there are doubts about the customer's age.

4. Prices

All prices are stated in Swiss francs (CHF) and include statutory VAT. The price displayed at the time of ordering applies. Price changes, errors and misprints remain reserved.

5. Payment

The available payment methods are displayed during checkout (e.g. Twint, credit/debit card). Payment is processed by a certified Swiss payment service provider. The goods remain the property of iVape until full payment has been received.

6. Delivery

Delivery is made exclusively to addresses in Switzerland. Orders received on working days (Monday–Friday) by 5 pm are generally dispatched the same day by A Mail. Shipping is free from an order value of CHF 29.–; below this, a shipping contribution of CHF 4.90 is charged. Delivery time information is non-binding; liability for delays is excluded to the extent permitted by law.

7. Duty to Inspect and Notify Defects

The customer must inspect the goods immediately upon receipt. Obvious defects or wrong deliveries must be reported within 7 days of receipt by email to i@ivape.ch.

8. Returns and Exchanges

The provisions of the Right of Withdrawal apply. For reasons of hygiene and product safety, opened or used e-cigarettes, pods and e-liquids are excluded from return and exchange unless the product is defective.

9. Warranty

Statutory warranty rights apply. In the event of justified defect claims, iVape will, at its own discretion, provide a replacement delivery or refund the purchase price. Further claims are excluded to the extent permitted by law.

10. Liability

iVape is only liable for direct damage caused by gross negligence or intent. Liability for slight negligence, indirect damage and consequential damage is excluded to the extent permitted by law. The products must be used exclusively as intended and in accordance with the product information.

11. Data Protection

iVape's Privacy Policy applies.

12. Applicable Law and Jurisdiction

Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Zurich, unless mandatory statutory provisions provide for a different jurisdiction.

13. Final Provisions

Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. iVape may amend these Terms and Conditions at any time; the version published at the time of the order applies.
